Terms of service
Terms of service
The terms that apply when you use our free check or buy a report, Fix Pack, add-on or monitoring.
1. About us
These terms are between you and Macuno Ltd, trading as Macuno Digital ("we", "us"). Macuno Ltd is registered in England and Wales, company number 16406548, registered office 71–75 Shelton Street, Covent Garden, London WC2H 9JQ. Email: hello@macunodigital.com.
2. Business customers only
Our services are for businesses only. By requesting a free check or placing an order, you confirm that you are acting for the purposes of your trade, business or profession, and not as a consumer. Because our customers are businesses, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 do not apply, and there is no statutory 14-day cancellation right. Your cancellation and refund rights are set out in section 8.
3. Our services and scope
- Free check: one finding from the core checks, with evidence and the rule, plus a summary of the other core checks. No charge and no obligation.
- Full report (£79): every core check that applies to your website. These are company details; cookies and trackers before consent; privacy notice; data protection complaints route; email sign-up consent; and, if you sell to consumers online, online shop cancellation information. Each finding sets out what we found, the evidence, the rule and a suggested fix.
- Fix Pack (£295): ready-to-use wording and step-by-step instructions for the items in your report: company details text, cookie and consent set-up notes, a privacy notice written from your questionnaire answers, a data protection complaints page and form wording, returns and cancellation wording if you sell to consumers, and email sign-up wording. Includes one re-check within 60 days of delivery.
- Sector add-ons: solicitors (£149) and smart or connectable products (£195), each checking the sector rules described on our website and providing wording you complete with your own figures.
- Monitoring (£49 a month): a monthly re-check of the checks that apply to your website, an email when we see a change, and reminders when your policies are due for review.
We check the public pages of one website (one domain), up to 60 pages per check. We don't log in to your website, test password-protected areas, or carry out security testing. A report describes what we found on the date shown; websites change after that date.
4. Not legal advice
Our reports, Fix Packs and other materials are information, not legal advice. We are not a law firm and are not regulated by the Solicitors Regulation Authority. We tell you what we found and which rule it relates to, and suggest wording. We do not confirm or certify that your website, or your business, complies with the law, and we can't guarantee any outcome, including the outcome of any regulator's review. You are responsible for deciding what changes to make. For complex situations, such as health data, children's data or CCTV, please take advice from a solicitor.
Macuno Digital is independent and is not connected with, or endorsed by, the ICO, Companies House or any regulator.
5. What we need from you
- Accurate information, including your website address and, for the Fix Pack and add-ons, complete answers to our questionnaire.
- Your real figures where wording needs them, such as fees, prices, retention periods or support periods. We don't invent these.
- Making the changes yourself, or through your developer. We don't ask for, or accept, website or account passwords.
- Please don't send us personal data about your customers or staff unless we ask for it.
6. Delivery
We deliver everything by email. Our target times are: free check within 5 working days of your request; full report within 5 working days of payment; Fix Pack within 10 working days of receiving your completed questionnaire; sector add-ons with the report or Fix Pack they are added to. These are targets, not guaranteed dates. If we expect a delay, we'll tell you.
7. Prices and payment
Prices are in pounds sterling. Macuno Ltd is not VAT registered, so no VAT is charged and the prices shown are the full amount you pay. If we register for VAT in future, we'll update our prices for new orders only.
You order by email, and we send a Stripe payment link. You pay in full before work starts. Monitoring is paid monthly in advance by Stripe subscription. If you buy the Fix Pack within 30 days of receiving your full report, we credit the £79 report fee against the Fix Pack price.
8. Cancellation and refunds
- Before work starts: you can cancel by emailing us and we'll refund you in full.
- After work starts but before delivery: you can cancel and we'll refund the price less a fair amount for work already done, which we'll explain.
- After delivery: reports and Fix Packs are not refundable once delivered. If what we deliver doesn't match the description in these terms, tell us within 30 days and we'll put it right or, if we can't, refund you.
- Monitoring: cancel at any time by email or through the Stripe subscription. It stops at the end of the month you've paid for. We don't refund part-months.
- Our cancellation: we may decline or cancel an order, for example if a website is outside our scope. If we do, we'll refund anything you've paid for work not done.
9. Ownership of the work
Once you've paid, you may use, copy and adapt the report and the wording we provide for your own business. We keep ownership of our templates, methods and tools, and may reuse general wording that doesn't identify you.
10. Our liability
We provide our services with reasonable care and skill.
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited or excluded by law.
Subject to that, we are not liable for: loss of profit, revenue, business, contracts or goodwill; any indirect or consequential loss; or fines, penalties or regulatory action arising from the content of your website or how your business operates. Our total liability to you for all claims connected with our services is limited to the total amount you have paid us in the 12 months before the claim arose.
11. Personal data and confidentiality
We handle personal data as described in our privacy notice. We keep your questionnaire answers and reports confidential and don't share them, except with our service providers as described there or where the law requires. We may describe the format of our work using fictional examples, never your details.
12. Complaints
If you're unhappy with our service, please see our complaints page. We acknowledge every complaint within 30 days.
13. General
We may update these terms; the version on our website when you place an order applies to that order. If any part of these terms is found to be unenforceable, the rest still applies. These terms are the whole agreement between us for the services. Nobody else has rights under these terms.
14. Governing law
These terms, and any dispute about them, are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction.
